56YO Man Jailed 4.5 Years for Committing Incest With His Daughter 3 Days After His Prison Release
On Monday (21 Jun), a 56-year-old man was sentenced to four-and-a-half years’ jail for committing incestuous acts with his biological daughter in 2019, reported TODAYonline.
He cannot be named to protect the identity of his daughter, now aged 32-years-old.
The man pleaded guilty to one count of incest and another charge of attempted incest under Section 376G of the Penal Code. Those convicted can be jailed for up to five years for each offence.
Under the law, anyone aged 16 or above can be charged with incest if they engage in acts of sexual penetration with any of these close family relatives: grandchild, child, sibling, half-sibling, parent, or grandparent.
In addition to his four-and-a-half years’ sentence, he also has to serve another 592 more days behind bars for breaching a remission order. He committed the first offence a mere three days after being released from prison for drug-related offences.
TODAYonline noted that this particular case was rather rare as most cases of sexual conduct between close relatives involve assault. The prosecution did not allege assault in this case.
However, the man was initially charged with rape.
Incident Timeline
On 14 May 2019, the man was released from jail after serving a five-year sentence for drug-related offences.
He went to stay at his daughter’s house in Queenstown, sleeping in the living room while she slept in her bedroom.
Three days later, he climbed onto her while she was still awake and had sexual intercourse with her for about five minutes without wearing a condom.
Four months later, on 20 October 2019, he tried to unsuccessfully have sex with her when they were both alone in the flat, watching videos together on her bed.
These incidents were revealed when his daughter was admitted to the National University Hospital (NUH) for health problems on 13 November 2019. She had told a medical social worker that she was scared of staying at home alone with her father and that sexual intercourse had taken place between them.
The man was charged shortly afterwards. He has been in remand since 20 November 2019.
In committing the above offence, he had breached a remission order that would have been in effect till 11 January 2021. Back in 2016, he was punished with five years’ jail for possessing and consuming heroin.
Prisoners who show good conduct are allowed to be released after serving two-thirds of their sentence and will be issued with a conditional remission order.
The prosecution told the court that he had a past criminal history dating back to 1995. He was jailed back in 1999 for criminal intimidation and had been sent to the Drug Rehabilitation Centre in 2001 and 2002. The man had also been placed under a drug supervision order in 2004 and 2019.
“While the victim was not young or vulnerable, the age difference between you and your daughter was more than 20 years… Both the offences were committed within a home, which is meant to be a sanctuary for families,” noted District Judge Janey Wang.
